“AGC did not interfere in Shuhaily’s transfer back to PDRM”

ATTORNEY General Tan Sri Mohd Dusuki Mokhtar says the Attorney General’s Chambers (AGC) did not interfere in the Home Ministry’s decision to return Datuk Seri Mohd Shuhaily Mohd Zain to the Royal Malaysia Police (PDRM).

Shuhaily previously served on a cadre secondment contract as Director-General of the Single Border Agency (AKPS).

He explained that the AGC’s role is strictly limited to providing legal advice.

“However, as of now, we have not provided official legal advice to the relevant parties because the case has not yet been referred to AGC,” he said.

“Datuk Seri Shuhaily is in fact a police officer but was seconded on contract to AKPS. Whether Datuk Seri Shuhaily remains at AKPS or is transferred back to PDRM, we do not interfere because it is primarily an administrative matter on the ministry’s part,” he added.

He reiterated that since Shuhaily remains a police officer by core service, his placement back into PDRM falls within ministerial administrative jurisdiction.

Reports said Home Minister Datuk Seri Saifuddin Nasution Ismail finalised the decision last week.

Ten days ago, Shuhaily pleaded not guilty at the magistrates’ court here today to assaulting two police officers last month.

Shuhaily is charged with two counts under Section 323 of the Penal Code for voluntarily causing hurt to Faiz Saman and Ekmal Sofwan at KLIA Terminal 1 on Sept 28.

If convicted, he faces up to a year in prison, a fine of up to RM2,000 or both, for each charge. — Oct 31, 2026
