FORMER Kedah state executive councillor Asmirul Anuar Aris has urged lawmakers in the state not to spark a debate on staking a claim over Penang during the state legislative assembly sessions.
According to the Pakatan Harapan’s (PH) Kubang Rotan state assemblyman, elected representatives should instead focus on more pressing issue such as the general well-being of the public.
While the history of the neighbouring states during the British colonial era is open to interpretation, Asmirul thinks that Penang’s status under the Federal Constitution should be respected.
“In reference to the Federal Constitution, I would like to draw attention to the federal list and concurrent list which clearly outline the powers and responsibilities of the federal and state governments. Article 74 of the constitution outlines the rights of state governments,” he stated this when debating a motion of appreciation for the Sultan of Kedah’s royal address at the start of the state assembly meeting on Sunday (March 12).

“The history is up for interpretation. However, it was invalidated after the formation of the Federation of Malaya and through the enactment of the Federal Constitution via the provision that I have mentioned.”
Added Asmirul: “It’s counter-productive (to debate the issue). We should be discussing more important issues such as the welfare of the people instead.”
Article 74 of the Federal Constitution acknowledges state governments’ autonomy in certain matters but limits their powers in areas where the federal government has jurisdiction.
Asmirul also encouraged the state and federal governments to work together to ensure growth. “By avoiding excessively aggressive political statements and maintaining professionalism, the strained relationship between the state and federal governments can be mended,” he added.
On March 7, Penang Chief Minister Chow Kon Yeow expressed concern about remarks made by Kedah Menteri Besar Datuk Seri Muhammad Sanusi Md Nor who questioned Penang’s sovereignty.
Chow warned Sanusi that if he failed to take caution when discussing Penang’s sovereignty, he could face legal consequences under the Sedition Act. – March 14, 2023
