RHB files third party notice to Supermax head honcho Stanley Thai

RHB Bank Bhd has filed a third-party notice to Supermax Corp Bhd executive chairman Datuk Seri Stanley Thai Kim Sim to indemnify the Bank and its officers in relation to a suit filed against it by entrepreneur Datuk Wira Cheryl Tan Bee Geok.

Tan is suing RHB in relation to the remittance of funds from a RHB joint account held by her and Thai into their Hong Leong joint bank account.

In RHB’s third party notice to Thai filed in the Kuala Lumpur High Court on April 29, 2025 obtained by FocusM, RHB said Thai was liable to fully indemnify the Bank and its officers against Tan’s claim, including damages, costs and interests ordered by the Court and all legal costs incurred and/or suffered by RHB and its officers.

RHB said that this was based on the grounds that among others, Thai was a joint account holder with Tan. On Sept 2, 2024, Thai submitted a remittance application form to RHB to transfer RM1,325,700 from the RHB joint account into their Hong Leong Bank joint account.

Thai provided, among others, the following to RHB:

  • A redemption statement request to Hong Leong Bank signed by him and Tan;
  • A redemption statement issued by Hong Leong Bank Bhd to Thai and Tan.

In fact, the co-founder of one of Malaysia’s Big Four glove makers told RHB and its officers orally and/or in writing that the redemption statement request was signed by Thai and Tan. He also said the payment needed to be completed promptly to avoid any late charges.

RHB’s employees processed the payment in good faith pursuant to Thai’s representations and instructions.

On this note, RHB said Thai has a duty to provide true, correct, authentic and/or accurate documents, information, representations and/or instructions – either orally or in writing – to RHB for the payment to be made from the RHB joint account.

In the third-party notice, RHB said Tan has alleged that, among others, Thai used an outdated form with Tan’s outdated signature to request for the redemption statement.

As such, if Tan’s claim against RHB is allowed, Thai shall be liable to and fully indemnify RHB against, or make contributions to, the claims, liability, loss, damage and costs incurred and/or suffered by RHB arising from RHB’s acceptance of the documents, instructions, representations and/or information given by Thai to RHB.

It said Thai shall be liable to and fully indemnify RHB and its officers against Tan’s claim or make contributions to RHB and its officers in respect of Tan’s claim. – June 2, 2025
