DASH sub-contractors sues turnkey contractor to recover unpaid RM100 mil

MELIMA Consortium (Melima), the group of four subcontractors left out of pocket by almost RM100 mil as a result of a legal dispute between the Damansara-Shah Alam Elevated Expressway (DASH) project’s turnkey contractor Turnpike Synergy Sdn Bhd and main contractor Panzana Enterprise Sdn Bhd, that filed legal proceedings against Turnpike Synergy to claim payment for works done on the DASH project.

The consortium is further seeking a restraining order against Turnpike Synergy and its representatives from dealing with materials belonging to Melima left on-site following the termination of its contract.

Responding to Turnpike Synergy’s statement dated July 6, Melima’s representative Alex Toong said: “We were very surprised about the manner in which Turnpike Synergy reacted to our media statement (dated July 6) after having ignored our repeated attempts to engage with them directly on a multitude of outstanding issues and only addressing part of the payment actually due to us.”

“Specifically, it does not address payment for completed but uncertified works done which were jointly measured with Turnpike Synergy’s consultants, Melima’s materials and equipment that we have had to leave on-site when terminated, and Turnpike Synergy’s new contractor commandeering and making use of our equipment and materials, amongst others.”

Toong expressed the regret that Turnpike Synergy’s statement to the media failed to address any of those issues, the hardship that their actions have caused Melima, its sub-contractors, suppliers, workers and their families particularly as everyone is struggling with the compounding impact of the pandemic.

“Based on the advice of our solicitors, we have been left with no other recourse but to file a claim against Turnpike Synergy and a restraining order to protect our interests,” added Toong.

Melima Consortium comprising sub-contractors Pembinaan Melima (M) Sdn Bhd, Pembinaan Thin Chai Sdn Bhd, Prosper Apex Sdn Bhd and Tropical Profile (M) Sdn Bhd Group of Companies had commenced work in 2019 on the CA4 rescue package under the DASH project having been appointed by Turnpike Synergy’s main contractor Panzana. – July 8, 2021
