SC and MACC probing each other: Is this proper? Gobind asks AG

STATE your stand on the criss-cross probe between Malaysian Anti-Corruption Commission (MACC) and Securities Commission (SC), Puchong MP Gobind Singh Deo urges Attorney-General Tan Sri Idrus Harun.

“How can both MACC and SC effectively carry out probes against each other? More so when the investigations concerned involve complaints against top ranking officials currently serving in those institutions” Gobind enquired in a Facebook post.

On Jan 6, it was reported that the SC would be probing MACC chief commissioner Tan Sri Azam Baki over concerns involving certain shares held by him but is being utilised by his brother, which is violation of Section 25 of the Securities Industry (Central Depositories) Act 1991 (SICDA).

In another turn of events, it was reported on Jan 11 that the MACC had received complaints against certain individuals in the higher management of SC, where they were alleged to be involved in matters which could lead to conflict of interest.

On that note, Gobind argued with both the MACC and SC investigating each other, it could compromise the probe.

“Azam remains the head of MACC. Section 5 of the MACC Act states that the MACC chief is responsible for the direction, control and supervision of all matters relating to the commission.

“And the report against SC refers to individuals in the higher management and board of directors of commission. Do they have a say in how investigations are conducted in the SC?” the former minister asked. – Jan 16, 2022.
